The draft EPR rules were applicable to producers, importers, and brand owners planning to launch their products in India. The regulation clearly prioritizes the recycling and reuse of plastic waste. Other plastic wastes that can not be recycled like multilayered and multi-material plastic need to be sent for lifetime disposals like road construction, waste to oils, and more. The regulators clearly stated that every manufacturer and regulator needs to declare to the government the amount of plastic waste collected and what mechanism they are using to collect it back. Category II - Flexible Plastic Packaging Of A Single Layer Or Multilayer (More Than One Layer With Different Types Of Plastic), Plastic Sheets Or Like And Covers Made Of Plastic Sheet, Carry Bags, Plastic Sachets Or Pouches

Annual Compliance

After registration, all the registered applicant have to fulfil the post compliances. As per the plastic rule, all the PIBO fulfill their EPR responsibility with the registered recycler

There are three steps of annual return :

  1. Submit the last year purchase and sales data
  2. Purchase the EPR target with the registered recycler
  3. Submit the annual report with the annual maintenance government charges

EPR for Electronic Waste (E- Waste)/Annual Compliance

EPR Authorization Must For All Companies Generating E-Waste, Under the Plastic Waste Management Rules 2016, the manufacturers and importers are given the responsibility to dispose or recycle their e-waste in a manner that is environmentally sound. This is known as EPR Authorization. EPR basically stands for Extended Producer Responsibility. Under EPR, three types of authorizations are given:

  • Manufacturing Authorization
  • Import Authorization
  • Wholesale Authorization

Out of the three, obtaining the manufacturing authorization is considered to be the toughest. Obtaining this authorization is compulsory for all Indian and foreign companies dealing in electronic waste. Companies failing to obtain this authorization can face imprisonment for a period of 5 years and/or fine of 1 Lac rupees.

EPR for Battery Waste/Annual Compliance

The Batteries (Management and Handling) Rules, 2001 were replaced by the most recent Battery Waste Management Rules, 2022, which went into effect in August 2022.

Any Producer, Manufacturer, Dealer, other Entity, or Consumer who participates in the collection, transportation, segregation, or any other process related to the management of Waste Battery is subject to these regulations. In addition, these rules apply to all batteries, including automotive batteries, electric vehicle batteries, industrial batteries, and portable batteries, regardless of their chemistry, volume, material composition, shape, weight, or use. These new rules also include a number of provisions relating to definitions, new roles, and authorization procedures.

Types Batteries Regulated Under Battery Waste Management Rules, 2022
  • Automotive batteries - means any Battery used only for automotive starter, lighting or ignition power. They are also known as car batteries.
  • Electric Vehicle battery - means any Battery specifically designed to provide traction to hybrid and electric vehicles for road transport. Use lithium-ion batteries used in E-Scooters, E-bike, and E-car etc.
  • Industrial batteries - means any Battery designed for industrial uses, excluding Portable battery, Electric vehicle battery and automotive battery. These may include sealed Battery (excluding potable battery); unsealed Battery (excluding automotive Battery) and energy storage system Battery
  • Portable Batteries - means Battery that is sealed, less than five kilograms, not made for industrial purposes, electric vehicle or to be used as an Automotive Battery.
